How Highlighting Scandals of Justices Alito and Thomas Can Keep Democrats in the Senate Majority
In light of the upcoming elections this November, Democratic nominees for the U.S. Senate have a prime opportunity to utilize the low public approval rating of the Supreme Court, to hold on to their narrow Senate majority.
The looming corruption scandals surrounding Justices Samuel Alito and Clarence Thomas, two of the court's most conservative jurists, present a unique chance for Democrats to highlight the importance of Senate oversight in confirming judicial nominations and enacting a new code of ethics.
Democrats are at serious risk of losing their slim majority in November, as they must defend the seats currently held by Jon Tester in Montana and Sherrod Brown in Ohio, and Republicans are set to gain a seat in West Virginia.
Within the past year, reporters for ProPublica exposed a pattern of unethical behavior by Supreme Court Justice Clarence Thomas, revealing that he accepted luxury trips and gifts from billionaire donor Harlan Crow without disclosing them. He also received a loan for $267,000 from a “friend” to purchase a high-end RV. According to a report by the Senate Finance Committee, Thomas paid an unknown amount on the interest on the loan, before eventually having the entire principal balance forgiven.
Similarly, it was discovered that Justice Alito went on a luxury fishing trip with a GOP billionaire that later had cases before the court. Paul Singer, a hedge fund billionaire chartered a private jet that would have cost upwards of $100,000 had the justice had paid himself. Only a few years later, would the Supreme Court agree to hear a case involving Singer’s hedge fund. Alito did not recuse himself from the case and voted 7-1 in Singer’s favor.
Not disclosing gifts and refusing to recuse themselves when the appearance of a conflict of interest exists, seriously undermine and threaten the legitimacy of the Supreme Court as an institution.
In light of these allegations, many Democrats in Congress have been voicing their support for a binding code of ethics to apply to members of the Supreme Court. At this time, the code of ethics that all other federal judges must abide by, does not apply to Supreme Court Justices.
Now is the time for Democratic candidates to emphasize the need for thorough vetting and accountability in the nomination process and the need for greater balance on the court. By showcasing the importance of having ethical and impartial justices on the bench, Democrats can rally support for their Senate campaigns.
This messaging has the potential to secure Democratic Senate victories in “long-shot” battleground states like Missouri, Florida, and Texas.
The battle for control of the Senate will be critical to preventing the court from becoming even more radical. By emphasizing the need for a robust code of ethics for the Supreme Court and highlighting the risks of unchecked judicial power, Democrats can galvanize voters support and potentially secure victories in key battleground states. This strategy could be pivotal in maintaining their Senate majority and ensuring a more balanced and ethical judiciary.
